AN AMENDMENT TO AN ORDINANCE REGULATING THE ASSEMBLY OF PERSONS WITHIN THE TOWN OF
HANCOCK, DELAWARE COUNTY, NEW YORK
BE IT ENACTED by the Town Board of the Town of Hancock, Delaware County, New York, as follows:
ARTICLE I: Purposes.
Sec. l: The Town Board in order to promote proper protection, order, conduct, safety,
health, welfare and well-being of persons and property within the Town of Hancock, Delaware
County, New York, finds it is in the public interest to enact this Amendment to an Ordinance
enacted July l, l970, to Regulate the Assembly of Persons Within the Town of Hancock,
Delaware County, New York.
ARTICLE II: Additional Requirements.
Sec. 2.1: State Sanitary Code Requirements. All of the provisions of Part 7 of Chapter
I of the New York State Sanitary Code as they apply to Mass Gatherings are hereby incorporated
by reference into the Ordinance to Regulate the Assembly of Persons within the Town of
Hancock, Delaware County, New York to apply to assemblies as defined in said Ordinance.
Sec. 2.2: Proof of Financial Resources. The applicant and all partners and-or
shareholders owning more than a 5 percent interest in the applicant if the applicant is a
partnership or a corporation shall submit proof of financial resources sufficient to execute
the plans as submitted and each shall list all banks having accounts of the applicant and its
partners and shareholders as above designated, and shall list all sources of credit proposed
for the execution of the plans, and the applicant and each partner and shareholder as above
described shall execute a general consent for the officers of the Town of Hancock to
investigate and secure his financial reports and credit ratings.
ARTICLE III: Fees.
Sec. 3.l: Each application shall be accompanied by a fee in the amount of $300.00 at
the time of its submission. The fee shall compensate the Town for its examination and
processing of such application and shall not be refundable in whole or in part.
ARTICLE IV: Provisions of Prior Ordinance Continued.
Sec. 4.l: All the provisions of the Ordinance to Regulate the Assembly of Persons
Within the Town of Hancock, Delaware County, New York adopted by the Town Board of the
Town of Hancock on July l, l970 are enacted and incorporated by reference in this amendment.
ARTICLE V: Separability.
Sec. 5.l: Should any section or provision of this Ordinance be decided by any court
to be unconstitutional or invalid, such decision shall not affect the validity of the
Ordinance as a whole or any part thereof other than the part so decided to be unconstitutional
or invalid.
ARTICLE VI: Effective date.
Sec. 6l.: This Ordinance shall become effective l0 days after publication and posting
of this Ordinance pursuant to Section 133 of the Town Law.
