    No Civil Action for Condition of Highways #1

    TOWN OF HANCOCK

    LOCAL LAW NO. l YEAR OF l98l

    A Local Law providing that no civil action may be maintained against the Town of Hancock or the Town of Hancock Superintendent of Highways for any injuries or damages resulting from any defect or condition of any highway, bridge or culvert unless there has been prior written notice of such specific defect or condition given.

    BE IT ENACTED BY THE TOWN BOARD OF THE TOWN OF HANCOCK, as follows:

    Section l. No civil action shall be maintained against the Town of Hancock or the Town Superintendent of Highways of the Town of Hancock for damages or injuries to person or property sustained by reason of any highway, bridge or culvert being defective, out of repair, unsafe, dangerous or obstructed unless written notice of such specific defective, unsafe, dangerous or obstructed condition of such highway, bridge or culvert was actually given to the Town Clerk of the Town of Hancock or the Town Superintendent of Highways of the Town of Hancock.
    Section 2. Insofar as the provisions of this local law are inconsistent with the provisions of any other local law or act, the provisions of this local law shall be controlling.
    Section 3. This local law shall take effect on the twentieth day following its enactment.

SCHOONMAKER, Town Clerk of the Town of Hancock, Delaware County, New York, DO HEREBY CERTIFY, that I have compared the preceding copy of Local Law No. l Year of l98l with the original thereof, duly adopted by the Town Board of such Town at a Special Meeting of such Board held on the 21st day of October, l98l, and that the same is a true and correct copy of such Local Law of the whole thereof,
